General Terms and Conditions of Sale
Preamble
These General Terms and Conditions of Sale (GTC) are entered into between:
Fazaya.fr, owned by FAZAYA LLC, Registered office: Sharjah Media City, Sharjah, United Arab Emirates, registered number: 2114401, email address: contact@fazaya.fr, telephone number: +971 52 617 4191, hereinafter referred to as "the Seller".
Any user making a purchase via the website fazaya.fr, hereinafter referred to as "the Customer".
By accessing the website and placing an order, the Customer accepts these GTC without reservation.
Article 1 - Purpose
These GTC define the rights and obligations of the parties within the framework of the online sale of products offered by the Seller on the website fazaya.fr.
Article 2 - Products
The products offered for sale are perfumes, presented on the website with a precise description. The photographs and descriptions of the products are as accurate as possible but cannot guarantee a perfect likeness to the actual product.
Article 3 - Prices
Product prices are indicated in euros, inclusive of all taxes (VAT included), excluding delivery charges. The Seller reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time the order is validated.
Article 4 - Orders
Ordering Process
The Customer adds the products of their choice to their shopping cart.
The Customer validates their order after verifying its contents.
The Customer proceeds to payment via the secure payment methods offered.
Order Confirmation
An order confirmation will be sent to the Customer by email. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute concerning payment for a previous order.
Article 5 - Payment
Payment is made online via secure payment methods. Payment information is never stored by the Seller.
Article 6 - Delivery
Delivery Times: Products are delivered to the address provided by the Customer when placing their order. Estimated delivery times are indicated on the website.
Delivery Costs: Delivery costs are specified during order confirmation.
Delivery Issues: In case of delay, the Customer will be notified by email. In case of a damaged package, the Customer must notify the carrier and the Seller as soon as possible.
Article 7 - Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 calendar days from receipt of the product to exercise their right of withdrawal without having to provide any justification or pay any penalties, excluding return shipping costs.
Article 8 - Warranty
The products are covered by the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the provisions of Articles 1641 et seq. of the French Civil Code.
Article 9 - Liability
The Seller shall not be held liable for damages resulting from misuse of the purchased product. The Seller's liability shall in any event be limited to the amount of the order.
Article 10 - Personal Data
The information collected is necessary for order management and service improvement. It is processed in accordance with the privacy policy available on the website.
Article 11 - Intellectual Property
All elements of the fazaya.fr website are and remain the exclusive intellectual property of the Seller. Any reproduction, exploitation, redistribution, or use of the website elements, whether software, visual, or audio, is strictly prohibited.
Article 12 - Dispute Resolution
In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing that, the French courts shall have exclusive jurisdiction.
Article 13 - Applicable Law
These Terms and Conditions are governed by French law.
